The provisions of this subchapter relating to procedures for creating, perfecting, assigning and satisfying security interests do not apply to the following: Â Â Â (1)Â Â A lien given by statute or rule of law to a supplier of services or materials for the boat. Â Â Â (2)Â Â A lien given by statute to the United States, the Commonwealth or a political subdivision of this Commonwealth. Â Â Â (3)Â Â A security interest in a boat held by a manufacturer or a dealer as described in 13 Pa.C.S. Â§Â Â 9311(d) (relating to perfection of security interests in property subject to certain statutes, regulations and treaties). Â Â Â (4)Â Â A lien arising out of an attachment of a boat. 1. Before selling your boat
Issuance by the Commission of a salvor’s certificate of title shall divest all rights, title and interest in the boat of the registered owner and all lienholders. Â Â Â (9)Â Â The Commonwealth, its agencies and political subdivisions may acquire title to any boat abandoned on areas under their ownership or control by proceeding in the manner set forth in subsection (b) or may follow the procedure set forth in this subsection. Mutilated or illegible titles shall be returned to the Commission with the application for a duplicate/replacement. Â (b)Â Â The duplicate/replacement title shall be marked ‘‘duplicate’’ on its face and shall be mailed or delivered to the applicant. Â (b)Â Â If a lienholder repossesses a boat by operation of law and holds it for resale, the lienholder shall secure a new title and shall pay the required fee.
